The purchase of goods and services from Metro Computers is subject to the following terms and conditions. By purchasing or receiving goods or services from Metro Computers, you accept the following terms and conditions:
Mandatory Repaired Notices
Equipment presented for repair may be replaced by new, used, or refurbished parts of the same type when repair cost is higher or unjustifiable.
Even though we take every precaution to avoid and any data loss, the repair of your equipment may result in the loss of any user-generated data. Please ensure that you have made a copy of any data saved on your equipment.
Services
Any period or date for delivery of goods or provision of services stated by us prior to the work being completed, is an estimate only. We will use best endeavours to meet any estimated dates for delivery of the goods or completion of the services and provide you with as much notice as possible of any expected delays.
You acknowledge and agree that we may need to take your system to our premise for diagnosis and repair. We will exercise all due care while in possession of your equipment to ensure that no loss or damage occurs.
Quotations & Estimates
Any verbal quote given by Metro Computers is given as a guide based on the limited information given/provided by a customer. A verbal quote is intended to give the customer an estimate of the price and is not an assurance that the product or service will be sold at that price. Metro Computers attempt to inform their customers of all possible price options prior to arrival based on the information provided by the customer.
Any written quote given by Metro Computers is a guarantee that the product or service will be provided at that price, based on the time validity of the Quotation/Estimate. Any delays may affect price and availability of the products or services requested.
Any piece of advertising material stating a fixed price for a product or service is valid only for the period stated on the advertising material or at the date of publication and may or may not be honoured at the discretion of Metro Computers.
Warranty
Metro Computers offers a 30 d ay warranty on all computer repair services excluding software problems and issues deemed caused by a third party.
If any software is changed (either by yourself or as an automatic update) after Metro Computers’ work is completed, any issues arising from that change will not be covered under warranty.
Any fault deemed to have resurfaced as a result of miss-use by the user, will not be covered by this warranty. Metro Computers will determine whether an issue has not been resolved correctly or has resurfaced as a result of miss-use.
Metro Computers offers a 7-day, 14-day, 30-day, 45-day, 60-day, or 90-day warranty on used or refurbished hardware and will be clearly stated on the invoice as such.
Metro Computers offers a 12-month warranty on all new hardware sold, and a 1-month onsite labour warranty (unless otherwise stated).
If a Metro Computers technician is called out to a premise for a warranty call, however it is deemed that the fault is not covered under warranty or caused by a different piece of hardware or software, the customer w ill be charged the appropriate rate for that service call.
Liability
Metro Computers will exercise reasonable care in handling any equipment which you provide to it.
You agree to indemnify and will keep Metro Computers indemnified against any claim, demand, injury, damage, loss, expense, cost, or liability (weather direct or indirect) made against or suffered by Metro Computers in connection with your equipment, your breach of these Terms and Conditions or your breach of any rights of third parties.
Where Metro Computers is liable to you under the Canadian Consumer Law, to the fullest extent permitted by law, its liability shall be limited, in its option, to:
– the replacement of your goods or the supply of equivalent goods;
– the payment of the cost of replacing your device or of the supply of an equivalent device; or refunding the amount of your order.
– supplying of the services again;
– payment of the cost of having the services supplied again.
Metro Computers will in no way be liable t o the customer or any third party for any accidental, consequential, or indirect damages resulting from the provision of the service. This includes but is not limited to:
- Damage to hardware
- Corruption or damage to software
- Data loss or data corruption
- Any damages related to downtime, interruption of business services, loss of profit or damage to goodwill.
Payment
Payment for Metro Computers goods or services must be made by Cash, Direct Deposit, eTransfer, Credit Card, PayPal, Cheque, or Western Union.
Payment must be made directly on completion of work, or at the time requested by Metro Computers. No credit terms are provided without prior approval from management.
Metro Computers services that a re charged at an hourly rate have a minimum charge of 1 hour labour.
All goods supplied by Metro Computers are charged separately from the services.
All visits by Metro Computers are chargeable unless, Metro Computers us unable to diagnose or suggest a solution to a customer’s problem.
Metro Computers may vary its price for goods and services without giving notice to the customer.
All services offered by Metro Computers are subject to our cancellation policy. If you give us less than twenty-four (24) hours’ notice to cancel any request for onsite service, then we will charge a cancellation fee equal to the first hour of service at the rates quoted at the time of booking for the loss and expense caused. All telephone calls are recorded to confirm your consent of this policy.
Customer’s Responsibilities
You represent and warrant to Metro Computers that you are the owner of, and/or have the right to be in possession of all equipment, data or media provided t o Metro Computers for repair. You further represent that you have the right to authorise Metro Computers to carry out repairs on your equipment.
You must back up all software, data and files that are stored on your computer and/or on any other storage devices you may have prior to the arrival of the Metro Computers technician. We and/or our third-party service provider shall not b e responsible at any time for any loss, alteration, or corruption of any such software, data, or files.
You warrant to Metro Computers that you hold all necessary licenses and approvals for any software item you request Metro Computers to install on your computer equipment. You agree to indemnify us and hold us harmless against any loss, damage, costs, hard or other expense whatsoever arising either directly or indirectly as a result of us installing software at your request.
You must ensure that a person of at least 18 years of age is p resent for the duration of the provision of onsite services.
Metro Computers may vary its price for goods and services without giving notice to the customer.
All services offered by Metro Computers are subject to our cancellation policy. You must provide our technicians with:
- Access to the areas of your premise necessary to provide services.
- Necessary passwords to your computer.
- A safe working environment and working space.
- Electrical power and internet access (where applicable).
If the services involve the installation of software, then you must provide our technicians with the installation media for your operating system or software along with the required product keys, serial numbers or any activation information required for this software.
No Fix – No Fee Policy
If Metro Computers is unable to diagnose the cause of any software or computer hardware problem, nor suggest at least one (1) resolution to the problem (which may involve the need to purchase additional hardware or software) then no charge will apply to the customer.
Any service provided by Metro Computers will be provided free of charge, only where Metro Computers is unable to diagnose the cause of a problem or suggest a suitable solution. Metro Computers will, at its sole discretion decide whether a service will be provided free of charge.
If a Metro Computers technician has the skill to resolve an issue, and the customer chooses not to proceed with their recommendation – standard fees and charges for the diagnostics apply and are payable to Metro Computers.
Same Day Servicing
All requests for same day service are honoured on a best effort basis but may not always be possible due to illness or periods of staff leave. Metro Computers apologises in advance if we are unable to provide same day service to you for any reason.
We do not guarantee that all necessary work can be completed at the initial appointment.
Confidentiality
Metro Computers will use the information provided by the customer only for the purpose of data recovery procedure and will use its best efforts to treat customers’ information as strictly confidential.
Security
Metro Computers website has security measures in place to protect the loss, misuse, and alteration of the information under our control. This security involves secured server SSL encryption of data.
Refunds and Exchanges
It is your responsibility to ensure that any equipment ordered is suitable for your needs before you place your order.
Metro Computers allows 14-day return policy on most “Brand New” hardware, except special order hardware. All returns must have a valid reason.
Metro Computers must approve all returns before the hardware is returned to us.
Depends on the situation and condition of the returned equipment and it’s original packaging, there may be restocking fee which will be estimated on a case-by-case basis.
